Decision making (Cabinet and Committee information)
Full Council : Terms of Reference
Full Council may exercise all of the functions exercisable by a District Council or may delegate the exercise of any of its functions as far as is legally permissible to Committees, Sub Committees or officers. Where functions are delegated by Council to its Committees/Officers Council may only amend or remit delegated decisions in exceptional circumstances and after taking full account of the consequences of such action.
Council shall exercise the following functions:-
1. all functions reserved to the Council by statute, subordinate legislation or Council Procedure Rules
2. adoption of the policy framework of the Council including the plans and strategies set out at (a) above and the budget
3. adoption, and amendment from time to time, of any statutory or other code of conduct for members
4. adoption or changing the constitution pursuant to the Local Government Act 2000, including agreeing and/or amending the terms of reference for committees and panels deciding on their composition and making appointments to them.
5. election of Chairperson and appointment of Vice-Chairperson of the Council
6. appointing representatives to outside bodies (where not delegated)
7. set rate of council tax to be levied and council tax base
8. determining the scheme and amounts of member's allowances
9. authorisation of applications pursuant to Leasehold Reform, Housing & Urban Development Act 1993 (Housing Land Transfer)
10. adoption of any plan or strategy for the control of borrowing or capital expenditure including annual capital and revenue budgets
11. to consider appropriate motions in accordance with Council Procedure Rules
12. determination of casual vacancies, matters referred to it for decision and resolution of conflicts between committees
13. determination of minimum work programme of scrutiny committees and resolution of recommendations from these committees
14. commissioning and receiving of reports from committees
15. confirming the appointment of the Head of Paid Service (Chief Executive)
16. determine whether or not to accept a delegation of functions from another Council
17. Scheme of delegation to officers except the appendices
18. Appointment of co-optees to any of the Council's committees
19. Approval of any draft plan or strategy required to be sent to the Secretary of State or Minister of the Crown for approval
20. Promoting or opposing the making of local legislation or personal Bills
21. Approval of the Annual Statement of Accounts and receiving District Audit's Management letter and any other statutory reports
22. Making, amending, revoking, re-enacting or adopting byelaws
