Decision making (Cabinet and Committee information)

Standards Committee : Terms of Reference

Membership:

  • 3 elected district Council members (who shall not be the leader of any political group)
  • 2 independent persons (who shall not be councillors or officers of the Council or any other body having a local authority standards committee under the Local Government Act 2000)
  • 2 elected parish Council members, one from each of the parish Councils in the district
  • Quorum: 3 - 1 district member, 1 independent (and 1 parish member for parish matters)

Advisory Functions

1. To make recommendations to Council in respect of its statutory functions including the following:-

(a) Promoting and maintaining high standards of conduct by councillors and co-opted members;

(b) Advising the Council on the adoption or revision of the Members Code of Conduct;

(c) Assisting the councillors and co-opted members to observe the members Code of Conduct;

(d) Monitoring the operation of the members Code of Conduct;

(e) Advising, training or arranging training councillors and co-opted members on matters relating to the Members Code of Conduct;

(f) Where appropriate, to grant or seek dispensations for councillors and co-opted members from requirements relating to interests set out in the Members Code of Conduct;

(g) Dealing with any reports from a case tribunal or interim case tribunal and any reports from the Monitoring Officer on any matter which is referred by an ethical standards officer to the Monitoring Officer;

(h) Recommendations on changes to Council Procedure Rules as appropriate and any appropriate guidelines relating to member conduct;

(i) Reviewing the public register of member interests;

(j) Commenting on any issue relevant to the committee's powers raised by the Council's auditors or the Local Government Ombudsman;

(k) Such Sub Committees as are necessary to hear complaints referred to the Standards Committee from the Standards Board for England.

Delegated Functions

1. To elect a Chairperson and Vice Chairperson (from the district and independent members). Parish members shall not be entitled to vote on this matter.

Onward Limits on Delegations

Delegations to Corporate Directors and any limitations imposed are set out in the scheme of delegations to officers.
