Promoting your event : Guidance for charitable groups and organisations

Adur District Council aims to reduce fly posting through its Street Scene Initiative and has introduced an approval system for the erection of posters or banners, backed up by enforcement for any unauthorised activity.

The erection of posters and banners can impact on the local 'Street Scene' and give the impression of urban decay; furthermore the erection of unauthorised posters and banners is considered fly posting and is illegal.

It is the council’s intention to be reasonable and it will assist and support charitable groups and organisations by offering suitable sites in the council’s ownership to promote their fundraising events etc.

Adur District Council will continue to operate a zero tolerance policy towards illegal fly posting and will remove any unauthorised fly posting.

Adur District Council is committed to creating a cleaner, safer, greener environment for all its residents.

This webpage gives guidance on some of the measures available for charitable groups and organisations to use to promote their activities. An application form is included below for those charitable groups or organisations, who would like to promote an event using the methods described below.

What is fly posting?

Fly posting is where posters and fliers are put on property and vehicles without permission and is defined as :

  • "the display of advertising material on buildings and street furniture without the consent of the owner, contrary to the provisions of the Regulations."

Councils can take action against those responsible for fly posting, remove illegal posters and placards and recover the costs incurred in doing so.

Councils can also order owners of a property to remove any posters displayed and issue fines to owners who refuse to do so. Legislation to assist with the removal of fly posting :

  • Under 'Section 224 of the Town & Planning Act 1990' it is an offence for any person to display an advertisement in contravention of the regulations. The relevant legislation is contained within the 'Town and Country Planning (Control of Advertisements) Regulations 1992'. Any person contravening the legislation is liable on summary conviction to a fine, currently not exceeding £2500. This was increased under the provision of the 'Anti-Social Behaviour Act 2003'. In the case of a continuing offence there is a fine of £250 for each day on which the offence continues after conviction .
  • Under 'Section 132 of the Highway Act 1980' it is an offence for any person to paint or in anyway inscribe or affix any picture, letter or sign on the surface of the highway, any tree, or structure without consent of the Highway Authority. If guilty of an offence the person can be liable to a fine of up to £1000, or in the case of a second offence £2500.

The 'Clean Neighbourhoods and Environment Act 2005' received Royal Assent in April 2005 and a particular emphasis throughout the act is a greater use of Fixed Penalty Notices (FPNs) for the offence of fly posting.

Opportunities to promote your activities with Adur DC

In an effort to minimise the effects of this policy the following methods will be available with Adur District Council for charitable groups and organisations to advertise or to promote their events or meetings :

Adur District Council may also authorise other promotional material banners or display boards for events on sites that it has ownership provided they :

  • Do not cause a hazard
  • Are not offensive or unsightly
  • Are erected not more than two weeks before the event and removed immediately after
  • Not a commercial event

Use of council open spaces and property

Organisers of events using council owned open spaces or property for events and funfairs are reminded that amongst the terms and conditions for their use is the following requirement :

  • In accordance with council policies, undertake not to advertise the event using the technique of 'fly posting' (see also : Fly posting webpage).

Your compliance with, and enforcement of, these terms and conditions is essential and disregard of any points will mean you will not be given consideration for such use of the site in the future.

Removal of posters, boards or banners erected without permission

Adur District Council has a joint contract for graffiti and fly posting removal with Worthing Borough Council and West Sussex County Council and contractors are working on behalf of all of these authorities to improve the Street Scene for all the residents of the area.

In accordance with appropriate legislation the following action will be taken :

  • Unauthorised banners, boards or posters occurring on street furniture, will be removed immediately and evidence will be taken for a potential prosecution

Application to display posters in bus shelters

Applications for the display of posters for community, charitable groups and organisations in information panels in bus shelters will be considered with the following conditions :

  • Advertising for commercial events is not permitted
  • Posters must be a maximum of A4 in size (portrait only)
  • Posters need to be laminated and must be forwarded to Street Scene at least four weeks before the event
  • The posters will be erected by a member of Adur Council staff
  • The council regrets that in cannot accept liability for any consequences in failing to erect posters in time

Application for the display of banners or display boards

Sites for which applications for the display of banners or display boards for community, charitable groups and organisations will be considered with the following conditions :

  • Advertising of commercial events is not permitted
  • The applicant is responsible for ensuring that they have adequate and suitable public liability insurance, that the banners are securely attached and that the positioning of any banner does not cause a conflict with any road users and road safety
  • Banners must be removed immediately after the event.
  • Adur District Council reserve the right to remove any banner that is considered insecure, inappropriate or a size in excess of that agreed
  • Applications must be received at least four weeks before the event

The safe erection and removal of banners or display boards is the responsibility of the applicant, once they have received notification of approval.

Banners or display boards must conform to the following :

  • No banner to exceed 3 metres in length and 1 metre in depth
  • No banner to be erected more than two weeks prior to the event and must be removed immediately afterwards
  • No more than two banners will be permitted per site
  • Applications will be considered on a first come first served basis
